INSIDER Promotion
OFFICIAL RULES
The following promotion is valid in
the 50 United States and District of
Columbia (“D.C.”) only
and shall be construed and evaluated
according to U.S. law. You may not
participate in this promotion unless
you are a legal resident of, and currently
located in, the 50 United States or
D.C.
NO PURCHASE NECESSARY. PURCHASE DOES
NOT INCREASE CHANCES OF WINNING. VOID
OUTSIDE THE 50 UNITED STATES AND D.C.
AND WHERE PROHIBITED. BEFORE ENTERING,
PLEASE NOTE THE FOLLOWING REGARDING
USE OF INFORMATION SUBMITTED IN CONNECTION
WITH YOUR ENTRY: By submitting an entry,
participant
certifies that they understand and
agree that the information submitted
will be provided to all “Promotion
Parties” of the UST “INSIDER” Promotion
(the “Promotion”). Such ”Promotion
Parties” include the following:
United Sports Technologies, ClubmakingWIRE
and their respective affiliated companies,
subsidiaries, parent companies, divisions,
distributors, dealers, retailers, printers,
and advertising and promotions agencies
and any and all other companies associated
with the design or execution of the
Promotion. Each participant, as a condition
of entry, certifies that the Promotion
Parties are hereby granted express
permission to contact entrant from
time to time to offer goods, services,
products and promotions. As a condition
of entry, participants grant the Promotion
Parties permission to contact participants
by any and all media, including, but
not limited to, direct mail, phone,
e-mail, or any other electronic media.
Who May Enter
Promotion is open to legal residents
of the 50 United States and D.C. who
are 18 years of age or older as of
date of entry. The following classes
of persons are NOT eligible to participate:
(a) Current or former professional
golfers as defined by USGA guidelines
(PGA, LPGA or any other professional
tour);
(b) Any current or former club professional
who has not achieved reinstatement
to amateur status;
(c) Any current NCAA, NAIA, JUCO or
High School golfers;
(d) Employees, officers, and directors
of, Promotion Parties, their respective
parent companies, affiliated companies,
subsidiaries, distributors, dealers,
retailers, printers, advertising, and
promotion agencies,
any and all other companies associated
with this Promotion, and the members
of the immediate families or households
of any of the above.
HOW TO ENTER
You May Enter in any of the following
two (2) Ways:
1. A maximum of one (1) official entry
per person per day will be distributed.
Fill out the required fields with you
and your friends email addresses.
2. On a 3” x 5” card, hand
print your complete name, address,
e-mail address (if applicable), date
of birth and phone numbers, and mail
it in a #10 envelope with first-class
postage affixed to: UST “INSIDER” Promotion,
c/o Circle M Design, PO Box 768, Leander,
TX 78641. You may enter via this 3” x
5” card method as often as you
like, but all such entries must be
mailed separately, be postmarked by
the published expiration date of the
Promotion. No mechanically reproduced
or photocopied entries permitted.
The Promotion Parties and their respective
officers, directors, employees, shareholders,
agents, independent contractors, representatives,
agencies and any other individuals
or companies participating in the design,
administration or fulfillment of this
Promotion (Collectively “Releasees”)
are not responsible for: any incorrect
or inaccurate entry information; human
error; technical malfunctions; inability
to connect to the website; theft, tampering,
destruction, or unauthorized access
to, or alteration of entries; typographical,
printing or other errors; any problems
with transactions, including, but not
limited to refused credit; or any entries
that are late, lost, incomplete, misdirected,
stolen, mutilated, illegible, postage
due or any combination thereof. All
such entries will be disqualified, as
will any entries submitted in a manner
that is not specifically
allowed under these Official Rules.
Proof of depositing or mailing entry
is not considered proof of delivery
or receipt. All entries become the
property of the Sponsor and will not
be acknowledged or returned. False,
fraudulent or deceptive entries or
acts shall render entrants ineligible.
By entering the Promotion, entrants
affirm that they have read and accept
these Official Rules. Any information
collected by registering to enter the
Promotion shall be used only in a manner
consistent with these Official Rules.
Finalist Selection & Notification
A random drawing will be held on or
about the Promotion’s published
expiration date by Circle M Design,
Inc. (“judges”). Finalist(s)
will be randomly selected from among
all eligible entries received from
all entry methods combined. Limit one
(1) Finalist per person and/or household,
unless otherwise noted in the published
Promotion. By participating in this
Promotion, entrants agree to abide
by and be bound by the Official Rules
and the decisions of the judges, which
shall be final in all matters relating
to this Promotion. Selected Finalists
will be notified by phone beginning
on or about the Promotion’s published
expiration date. After three (3) unsuccessful
attempts to reach a selected Finalist
by phone over a 48-hour period, that
participant will be disqualified and
another Finalist will be randomly selected
per the method outlined above. During
the notification phone call selected
Finalists must confirm their eligibility,
and indicate their willingness for
UST to publish their name and place
of residence for the purposes of marketing
UST, UST products and/or the UST “INSIDER” Promotion.
A selected Finalist that cannot or
does not wish to participate in UST
marketing efforts will be disqualified,
and an alternate Finalist will be randomly
selected.
LIMITATIONS ON LIABILITY/RELEASE
The UST “INSIDER” Promotion,
and all related name variations printed
on promotional materials, is a contest
name used for promotional purposes
only. By entering this Promotion, entrants
agree that the Releasees shall not
be liable for personal injuries, death,
damages, expenses or costs or losses
of any kind resulting from or in connection
with participation
or inability to participate in this
Promotion or acceptance, possession
or use or inability to use a prize
or parts thereof including, without
limitation, claims, suits, injuries,
losses and damages related to personal
injuries, death, damage to or destruction
of property, rights of publicity or
privacy, defamation or portrayal in
a false light (whether intentional
or unintentional), whether under a
theory of contract, tort (including
negligence), warranty or other theory.
By accepting prizes, winners
release the Releasees from any and
all liability and responsibility with
respect to the acceptance, possession
or use/misuse of prize or participation
in prize-related activities (including
any property loss, damage, personal
injury or death. Releasees shall not
be liable to winner or any other person
for failure to supply the prize or
any part thereof, by reason of any
acts of God, any action(s), regulation(s),
order(s) or request(s) by any governmental
or quasi-governmental entity (whether
or not the action(s), regulations(s),
order(s) or request(s) prove(s) to
be invalid), equipment failure, terrorist
acts, war, fire, unusually severe weather,
embargo, labor dispute or strike (whether
legal or illegal), labor or material
shortage, transportation interruption
of any kind, or any other cause beyond
Releasees’ sole control. In the
event the online portion of the Promotion
is corrupted for any reason, Sponsor
reserves the right to cancel the online
portion and to select Finalists from
among all valid online entries received
prior to the date such action was taken
combined with all valid mail-in entries
received during the entire entry period.
IN CASE OF DISPUTES
Each entrant agrees that (1) any and
all disputes, claims, and causes of
action arising out of or in connection
with this Promotion, or any prizes
awarded, shall be resolved individually,
without resort to any form of class
action, and any judicial proceeding
shall take place in a federal or state
court within the State of Texas; (2)
any and all claims, judgments, and
awards shall be limited to actual out-of-pocket
costs incurred, including costs associated
with entering this Promotion, but in
no event attorneys' fees; and (3) under
no circumstances will entrant be permitted
to obtain awards for, and entrant hereby
waives all rights to claim, punitive,
incidental, and consequential damages,
and any other damages, other than for
actual out-of-pocket expenses, and
any and all rights to have damages
multiplied or otherwise increased.
All issues and questions concerning
the construction, validity, interpretation
and enforceability of these Official
Rules, or the rights and obligations
of entrant and Sponsor in connection
with this Promotion, shall be governed
by, and construed in accordance with
the laws of the State of Texas, without
giving effect to any choice of law
or conflict of law rules or provisions
(whether of the State of Texas or any
other jurisdiction), that would cause
the application of the laws of any
jurisdiction other than the State of
Texas.
Warranty Disclaimer: All prizes are
awarded “AS IS”. Except
as otherwise provided in these Official
Rules, Releasees who are not the manufacturers
make no warranties, representations
or guarantees, express or implied,
in fact or in law, respecting the performance
or use of the prizes, including, without
limitation, quality, merchantability,
and fitness for a particular purpose,
and the winner shall look solely to
the manufacturer for such warranties,
if any. Odds: The odds of being selected
a Finalist are dependent upon the total
number of entries received from all
entry methods combined. Winners List:
